Introduction

These Terms of Service ("Terms") govern your access to and use of our pet platform application with AI-powered creation and productivity features, website, and related services (collectively, the "Services"). By downloading, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

The Services are not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe that a child has provided us with personal information without appropriate consent, please contact us so we can take appropriate action.

2. Accounts

  • Registration:To use certain features, you may be required to create an account by providing accurate and complete information (e.g., email, password).
  • Responsibility:You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
  • Security:Notify us immediately at support@huggingpet.com if you suspect unauthorized access or breach of security.

3. Services and Features

The Services include, but are not limited to:

  • AI-generated pet images, videos, and other media;
  • AI-powered assistance, including conversational features and health-related informational guidance;
  • Pet profile creation and management;
  • Reminders, notifications, and scheduling tools;
  • Optional premium subscriptions and in-app purchases.

We reserve the right to modify, suspend, or discontinue any feature or Service at any time, with or without notice.

4. User Content

4.1 Ownership

You retain ownership of any images, videos, audio, text, or other content ("User Content") you submit or generate using the Services.

4.2 License to Company

By submitting or generating User Content, you grant the Company a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, and distribute such content solely:

  • to operate, improve, and provide the Services;
  • to develop and train AI models (in aggregated and anonymized form);
  • to comply with legal obligations.

Where required by law, we will obtain consent, and you may request deletion of your content as described in our Privacy Policy.

4.3 Responsibility

You are solely responsible for your User Content. You agree not to upload, generate, or share any content that:

  • violates any law or regulation;
  • infringes on intellectual property rights;
  • contains harmful, obscene, sexually explicit (where prohibited), or abusive material;
  • misrepresents age, identity, or ownership of content.

We reserve the right (but have no obligation) to review, remove, or restrict any User Content that violates these Terms. We may provide reporting and moderation mechanisms, and we may suspend or terminate accounts for repeated violations.

5. Prohibited Conduct

You agree not to:

  • Use the Services for any illegal or unauthorized purpose;
  • Reverse-engineer, decompile, or attempt to extract the source code;
  • Interfere with or disrupt the security, integrity, or performance of the Services;
  • Use automated systems (bots, crawlers) to access the Services without our prior consent;
  • Circumvent any content moderation or security measures.

6. Subscriptions, Payments, and Refunds

  • Billing:Some features require an auto-renewable subscription or in-app purchases (e.g., credits). Pricing and subscription terms (including duration) are displayed at the time of purchase in the App Store.
  • Apple In-App Purchase:Purchases made on iOS are processed by Apple through In-App Purchase. We do not collect or store full payment card numbers. We may use service providers (e.g., RevenueCat) to manage subscription status and validate purchases.
  • Auto-Renewal:Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
  • Manage/Cancel:You can manage and cancel your subscriptions in your Apple ID account settings in the App Store.
  • Refunds:Refund requests for purchases made through Apple In-App Purchase are handled by Apple in accordance with Apple's policies.
  • Free Trials:If a free trial or introductory offer is available, it will be shown at the time of purchase in the App Store and will automatically convert to a paid subscription unless canceled before the trial ends.

7. Intellectual Property

All rights, title, and interest in the Services (including software, AI models, trademarks, and content excluding User Content) are owned by the Company or its licensors. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works of the Services.

8. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection, use, and sharing of your data as described in the Privacy Policy.

9. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE."

We make no warranties, express or implied, regarding the reliability, accuracy, or availability of the Services.

AI-generated content may contain inaccuracies or unpredictable results. You assume all risk for reliance on such content.

Health Information Disclaimer: The Services may provide AI-generated health-related information for informational purposes only. HuggingPet does not provide veterinary diagnosis or professional veterinary services. AI responses should not replace advice from a licensed veterinarian.

10. Limitation of Liability

To the fullest extent permitted by law, the Company and its affiliates shall not be liable for:

  • any indirect, incidental, special, or consequential damages;
  • loss of data, profits, or revenues;
  • damages resulting from unauthorized access or use of your account.

Our total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or the minimum amount required by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its officers, employees, and agents from any claims, damages, or expenses arising out of:

  • your use of the Services;
  • your User Content;
  • your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or for any other lawful reason. Upon termination, your right to use the Services will immediately cease.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles.

Any disputes arising under these Terms will be resolved exclusively in the courts of Singapore, unless applicable consumer protection laws require otherwise. Nothing in these Terms affects any mandatory rights you may have under applicable consumer protection laws.

14. Changes to the Terms

We may update these Terms from time to time. Changes will be posted in the App or on our website with a new "Last Updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
